ANTT authorizes expropriation of properties for the “JK Railway”

Construction of a railway aims to connect Barra de São Francisco (ES) to Brasília; Petrocity Ferrovias received the agency's approval.
ANTT (National Land Transport Agency) authorized this Wednesday (4.Dec.24) the expropriation of properties for the construction of the “JK Railway” (EF-0300, to connect Barra de São Francisco (ES) to Brasília.
With the Decision, Petrocity Ferrovias will be able to begin the process of implementing the 1,188 km established in the preliminary engineering project. Read the full document (PDF – 35 Kb).
The agency granted authorization which, based on previous studies, defines the area of real estate and public utility polygons required for the passage of rails.

By August 2024, the federal government had already authorized 24 companies to build 45 private railways since 2021. That year, former president Jair Bolsonaro (PL) launched Pró-Trilhos (Railway Authorization Program), with the possibility of companies requesting approval to have railways
own with 99-year licenses.
The current administration's assessment is that the Bolsonaro-era program was rushed. The Ministry of Transport wants to move forward with regulating aspects of the program before giving the green light to the projects.
There is another factor, which is the lack of sympathy for the model within the Lula government. The Minister of Transport, Renan Filho, has already called the projects “railroads of
paper” .
DIFFERENCE BETWEEN CONCESSION AND AUTHORIZATION :
concession: the railway is public, but granted for a certain period of time for operation by a company. It is done through an auction. The company is contractually committed to making investments, is obliged to grant the right of way and pay a concession fee to the government;
Authorization : the railway is private, with a 99-year license that can be renewed. There is no auction. The company is free to make investments and is not obliged to grant right of way on its track to other companies.
